What it means
The Financial Directorate of the Slovak Republic is the central body of the Financial Administration, based in Banská Bystrica. It directs tax offices, customs offices and the Criminal Office of the Financial Administration, issues methodological guidance and tax information and runs electronic services.
It is the superior body to tax and customs offices and decides appeals against their decisions. It also prepares tax return and report forms and runs the Financial Administration portal and systems such as eKasa and the VAT control statement.
For businesses, its most visible output is the information and guidance published on its website, explaining how VAT, income tax and accounting laws are interpreted. The Financial Directorate also issues binding rulings on the tax treatment of specific transactions.
How it works in practice
Guidance and information notes are not law, but tax offices follow them in audits in practice. A taxpayer who follows published guidance has a strong argument in a dispute, although a court may ultimately take a different view.
Where the tax treatment of a complex transaction is uncertain, a binding ruling can be requested for a fee. The ruling binds the tax authority if the taxpayer carries out the transaction exactly as described, and helps avoid disputes over significant deals.
The Financial Directorate also publishes lists of tax debtors, VAT payers with grounds for deregistration and the tax reliability index. These lists are worth checking when choosing business partners.
What to watch out for
The Financial Directorate's interpretation can change, and older information may be outdated after a change in law. When relying on guidance, check that it applies to the relevant period, and seek advice where significant sums are involved.
Electronic services such as eDane and the Financial Administration portal occasionally go down, especially in the last days before deadlines. The Directorate publishes notices about serious outages, but filing with time to spare is safest.
