What it means
The Social Insurance Act is Act No. 461/2003, which governs social insurance in Slovakia. It covers sickness insurance, pension insurance (split into old-age and disability insurance), accident insurance, guarantee insurance and unemployment insurance.
The act sets out who is compulsorily insured, who pays contributions and how much, the assessment base from which contributions are calculated and which benefits arise from each type of insurance, such as sickness benefit, maternity benefit, pensions and unemployment benefit.
Social insurance is administered by the Social Insurance Agency, which collects contributions, keeps records of insured persons and pays benefits. The act changes regularly, for example when rates, maximum assessment bases or pension calculation rules are adjusted.
How it works in practice
Employers must register employees with the Social Insurance Agency, calculate and pay contributions monthly for both employee and employer, and file monthly reports. Special rules apply to agreements on work outside employment, such as exemptions for students and pensioners.
Sole traders become compulsorily insured if their business income exceeds a statutory threshold. The Social Insurance Agency then sets their advance payments based on their tax return. They can insure themselves voluntarily even where no obligation arises.
The act also governs benefits that directly affect companies, such as sickness benefit paid by the Social Insurance Agency after the first days of incapacity, when the employer pays income compensation. Payroll must apply these rules correctly.
What to watch out for
Incorrect registration or deregistration of employees, late contributions or errors in reports lead to surcharges and fines. In inspections, the Social Insurance Agency also checks whether work agreements and other contracts are in fact dependent work on which contributions should have been paid.
Changes to the act, such as new rates, limits or rules on work agreements, often take effect from the start of the year and must be built into payroll software in time. When in doubt, it is wise to check the procedure with the Social Insurance Agency or a specialist.
