What it means
A zoning decision was, under the former Building Act, the decision that set a building's location, the land use and the project conditions before a building permit was issued. It was the first step in the permitting process for most buildings.
There were several types of zoning decision, for example on the siting of a building, on land use, on dividing and merging plots or on a building moratorium. The decision checked whether the plan complied with the municipal zoning plan and whether the affected authorities, utility operators and neighbours had been heard.
Slovakia's new Building Act, effective from 2025, merged the zoning and building procedures into a single permit for the construction project. Proceedings started before it took effect may still be completed under the original rules, and zoning decisions already issued remain important for projects under way.
How it works in practice
When buying land for construction or in a real estate development project, it is worth finding out whether a zoning decision has been issued and whether it is still valid. A valid decision raises the land's value, because the buyer does not have to start permitting from scratch.
A zoning decision had limited validity and lapsed if no application for a building permit was filed within the set period. For acquired projects it is therefore necessary to check which time limits apply and whether the switch to the new act affected them.
The zoning procedure relied on documents such as siting plans, an extract from the land register, a geometric plan and the opinions of affected authorities. These materials are often usable for subsequent steps under the new act too.
What to watch out for
The transition between the old and new acts creates uncertainty about which rules apply to a given project. Before making an investment decision, it is advisable to consult the building authority or a construction law specialist.
A zoning decision did not by itself entitle anyone to build. The developer also needed a building permit and, on completion, occupancy approval. When assessing a project's status, it is therefore important to distinguish which permits already exist and which are still missing.
